Process and Funding
Once you have instructed your chosen partner, they will be committed to obtaining the best possible outcome for you. The first stage in any process is that of initial advice. This ensures that the partner fully understands the history and issues associated with your specific case, assimilates any available material and formulates an initial opinion as to possible outcomes and the route forward. Other than in exceptional circumstances, you will need to fund the initial advice stage. The associated costs will, of course, be agreed with the partner firm prior to engagement.
Regulators in the legal profession, including the SRA (Solicitors Regulation Authority) provide guideline fees based upon location, practice area and experience. Our partners work within applicable guidelines from the regulator.
Following initial advice, in a high percentage of cases, it may be possible to reach a settlement through negotiation which should limit any further costs.
In situations in which a settlement cannot be reached, it may be necessary to move to litigation. Since this can be a costly process, it may be appropriate to consider litigation funding. This is a complex area which is subject to strict (and evolving) regulatory control. All of our partners have extensive experience in working with clients to identify the most appropriate option, based upon the matter in hand, the area of law, your financial resources, the likely outcome and value of any claim, together with a variety of other factors.
There are various options, including self-funding, DBA (Damages Based Agreements), CFA (Conditional Fee Agreement) which is commonly referred to as “no win no fee”, Discounted CFA, Part CFA, Fixed Fees, and other forms of Third Party Funding. Each has its pros and cons and there are strict regulatory limits as to the applicability of any given model and the recovery of any associated costs. Your chosen legal advisor will be able to discuss this with you in detail at the appropriate point.
